Terms & Conditions (T&Cs) – NORTHROW

By accessing our website and/or purchasing our products, you agree to the following Terms & Conditions.


1. Provider Information

2. Subject of the Contract

These Terms & Conditions govern the contractual relationship between North Row and customers for purchases made through our online shop.


3. Order Process & Conclusion of Contract

  • Product presentations on our website are non-binding invitations to place an order and do not constitute a binding offer.

  • A contract is concluded when you:

    1. Click the “Buy now” / checkout button, and

    2. Receive an order confirmation e-mail from us.

  • We reserve the right to decline orders for objective reasons (e.g. suspicion of misuse, non-availability). Any payments already made will be refunded in such cases.


4. Prices, Vouchers & Payment

  • All prices are shown including statutory VAT, where applicable, unless stated otherwise.

  • Shipping costs are shown separately during checkout.

  • We accept the payment methods displayed at checkout (e.g. credit/debit card, Apple Pay, Google Pay, other payment providers). Payments are processed via secure payment service providers.

Vouchers / discount codes:

  • Discount codes cannot be combined unless explicitly stated.

  • As a rule, only one code per order can be used.

  • Vouchers cannot generally be applied retroactively to already completed orders.


5. Shipping & Delivery

  • Order processing time: usually up to 5 business days after payment confirmation.

  • Delivery time: usually 10–15 business days (non-binding standard transit times, may vary by country or carrier).

  • Shipping is carried out via logistics and transport partners. Partial shipments may occur if necessary.

  • Transport damage must be reported to us within 48 hours of delivery, including photos and the order number, so that we can clarify the issue with the carrier.


6. Warranty & Lack of Conformity

Your statutory consumer rights remain unaffected.

In the event of defects or non-conformity of the goods:

  • Primary remedy is repair/rectification or replacement delivery (reshipment),

  • Free of charge for you,

  • Within a reasonable period,

  • Without significant inconvenience to you.

A price reduction or contract cancellation (withdrawal) is only considered if the primary remedies are impossible, fail, or would be disproportionate.


7. Returns Outside Statutory Withdrawal Rights

Returns outside any mandatory statutory withdrawal or cancellation rights are only possible:

  • With our prior consent, and

  • As a gesture of goodwill.

Gift cards / gift vouchers are generally non-refundable.

(If a specific return policy applies, it will be described separately on the website.)


8. Product Presentation & Tolerances

We aim to present our products as accurately as possible. However:

  • Slight, industry-standard deviations in colour, structure, or measurements (e.g. due to different screen settings, fabric batches or manual measurement) do not constitute a defect, as long as they are reasonable for the customer.


9. Customer Obligations

Customers agree to:

  • Provide accurate and complete shipping, contact and payment information.

  • Ensure that delivery is possible at the specified address (e.g. correct name on the doorbell, collection of parcels in due time).

  • Use the products properly and follow any care instructions (e.g. washing labels).

Costs incurred due to incorrect address, non-collection, or necessary re-delivery may be charged to the customer where the customer is responsible.


10. Liability

Where legally permitted:

  • In cases of slight negligence, we are liable only for breaches of essential contractual obligations (cardinal duties).

  • Liability is then limited to the foreseeable, typically occurring damage.

  • We are not liable for indirect damages or loss of profit, unless mandatory statutory liability applies.

Nothing in these Terms limits or excludes liability for:

  • Intent and gross negligence,

  • Injury to life, body or health,

  • Claims under product liability laws,

  • Any other liability that cannot be excluded under applicable law.


11. Force Majeure

In cases of force majeure (e.g. natural disasters, strikes, war, pandemics, serious disruptions of transport or energy), our performance obligations are suspended for the duration of the event and any deadlines are reasonably extended. We will inform you as soon as reasonably possible.


12. Retention of Title

Until full payment of the purchase price has been received, the delivered goods remain the property of North Row.


13. Set-off & Right of Retention

  • You may only set off your own claims against our claims if your counterclaim is undisputed, ready for decision, or has been finally adjudicated by a court.

  • A right of retention may only be exercised if it arises from the same contractual relationship.


14. Applicable Law & Place of Jurisdiction

  • Unless otherwise required by mandatory consumer protection law, the contract is governed by the laws of Germany (excluding the UN Convention on Contracts for the International Sale of Goods – CISG).

  • Mandatory consumer protection provisions of the EU member state in which you have your habitual residence remain unaffected.

  • If you are a business customer / entrepreneur, the exclusive place of jurisdiction for all disputes arising from this contract is the registered seat/location of North Row. For consumers, the statutory places of jurisdiction apply.


15. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) for consumers, available at:
https://ec.europa.eu/consumers/odr

We are not obliged and, as a rule, not willing to participate in dispute resolution proceedings before a consumer arbitration board.


16. Changes to These Terms

We may modify these Terms & Conditions from time to time. The version published on our website at the time of your order applies.
